As a part of its real estate practice, Kessler & Keirnan acts as title agent for several major title insurance companies to provide owner’s and lender’s title insurance commitments and policies. We also provide comprehensive title curative review and clearance services.

Title Insurance Commitments and Policies

Title insurance is an important tool for the protection of owners and lenders against loss arising from encumbrances, liens or other defects in the title or ownership of real property. Lender’s title insurance, which the borrower is required to purchase to protect the lender’s mortgage lien on the property, is one type of policy. Owner's title insurance, paid for by the seller to protect the buyer's equity in the property, is another type of policy. We are title agents for Chicago Title Insurance Company, First American Title Insurance Company, Fidelity National Title Insurance Company, Premier Title, and Affinity Title Services. Through this network, we are able to provide a full spectrum of title insurance commitments and policies for both residential and commercial real estate transactions.

Title Curative Review and Clearance

Having closed thousands of REO and conventional real estate transactions over the past several years, our team has acquired in-depth experience in identifying and resolving title problems. Prior to closing, our attorneys closely examine search packages produced by our vendor network to identify any chain of title issues, legal description variances, liens, judgments, unpaid real estate tax assessments, encumbrances, encroachments, use restrictions, easements, rights of way, restrictive covenants, boundary line agreements or other issues found in the land and other public records. Once the preliminary title insurance commitment is issued, we work closely with the title company to clear where possible title defects identified from our examination and isolate those issues — such as liens, judgments and mortgages — that must be satisfied or addressed prior to or at closing in order to transfer marketable and clear title to the buyer.
